By the use of DigiTech Studio and by providing information as a Client, you are agreeing to be legally bound by these Terms and Conditions of Use, which includes all terms, conditions, and notices that may appear in these terms and conditions. You should read these terms and conditions very carefully. If you do not accept these Terms and Conditions, do not use DigiTech Studio. By placing an order with DigiTech Studio, you agree to accept all terms and conditions, and you are responsible for reading our terms and conditions. DigiTech Studio reserves the right to revise these terms and conditions at any time by updating this posting. You should periodically check this webpage as these terms and conditions will bind you when you visit DigiTech Studio. For the purpose of these terms and conditions, all services provided by and related to DigiTech Studio, including without limitation, all text, images, photographs, user interface, look, and feel, data, and content contained at https://digitechstudio.com, including, without limitation, the selection, coordination, and arrangement of the aforementioned content, are sometimes referred to as the “Web Site” and/or “Service.”
You hereby acknowledge and agree that DigiTech Studio shall have the right, but not the obligation, in its sole discretion to pre-screen, refuse or remove any project and/or user provided content that violates these Terms and Conditions or is otherwise objectionable, including, without limitation, projects or content that is illegal, obscene, indecent, defamatory, incites religious, racial or ethnic hatred, or violates the rights of others. Activity that is brought to our attention which appears in our sole judgment to violate the law will be brought to the attention of the proper authorities. You acknowledge, consent and agree that DigiTech Studio may access, preserve, and disclose your account information and content if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to: (a) comply with legal process; (b) enforce these Terms and Conditions; (c) respond to claims that any content violates the rights of third-parties; (d) respond to your requests for customer service; or (e) protect the rights, property, or personal safety of Design Sketchers, its users and the public.
(a) Description of Service: Through the DigiTec Studio Site, Customers may submit their assignments or project descriptions (“Creative Briefs”), their requests for revisions (“Revision Briefs”), and receive from Members design solutions (“Responses”) from our professional designers (“Members”). Projects are developed through multiple iterative cycles of Creative Briefs, Revision Briefs, and Responses that continue until such time as a final Response meets your needs.
(b) Creative Briefs and Responses: Client shall be responsible for posting clear, detailed Creative Briefs, including samples and deadlines. Each Response is prepared based on the terms you provide (“Term Sheet”). DigiTec Studio is not responsible for reviewing your Briefs or Term Sheets for accuracy, completeness or clarity and may reject any Brief or Term Sheet at its discretion.
(c) Response Review: Clients are supposed to review the Responses and inform DigiTec Studio in case the responses are not adequate. If no notification is received, the Response shall be considered accepted. You may submit Revision Briefs for amendments, and further Responses would reflect your desired changes. Digitec Studio shall not be liable for any inaccuracies in Responses, prepared based on your instructions.
(d) Revision Cycles: Revision cycles allow for multiple adjustments to be made in order to move the project in your desired direction. Major changes are allowed in the first two cycles; further major changes may require a fee of $50. Paid revisions will only begin after your authorisation.
(e) Packages: There are various packages available, such as Logo Startup Design, Logo Classic Design, Logo DigiTec Studio, and Logo Unlimited Design.
(f) Client Accounts: Clients must pay the bills regarding services through the selected payment options. Additional products will also be charged separately, as applicable. Clients must provide valid credit card details and billing information. Receipts will be emailed to the clients. DigiTec Studio has the right to modify the fee structure, but the changes will not be applied to the already submitted projects.
(a) Creative and Response Briefs: When you submit any of the details, media, or materials associated with a project (“Client Information”), DigiTec Studios and the team have the right to use the Client Information to create Responses and for other purposes. The designers who are working on creating a Response for your project have the right to view Client Information.
(b) DigiTec Studios’ Rights: Your use of the Client Information service constitutes your irrevocable, non-exclusive, worldwide, royalty-free, sublicensing-free, and perpetual license to use, reproduce, modify, publish, perform, transmit, and distribute information contained in Client Information, in any form, by any method.
At DigiTec Studios, we respect our privacy policy and make every effort to protect your information; however, we cannot protect against misuse and unauthorized access like hacking and other malicious activities.
(a) Eligibility: The user of the service must be 18+ years of age, agree to these Terms, and go through the registration process. If the user is registering for a business, then we require that you have the authority to legally bind the business. DigiTec Studios reserves the right to refuse/accept any registrations.
(b) Prohibited Actions: You shall not hack into, reverse engineer, overload, spam, forge, or otherwise tamper with the website or the Services. You are liable to civil and criminal actions for such conduct, which DigiTec Studios can assist authorities in pursuing.
(c) Website Operation: sDigiTec Studios is not liable for delays, interruptions, or inaccuracies on the website. It is available as long as practical, and access to the service can be suspended or terminated without prior notification.
(d) Operation of Web Site. Digitec Studio shall not be responsible for any delays or interruptions of, or errors or omissions contained in, the Web Site.
(a) Responsibility for Content: We assume no liability for the use of the Service and website. We also do not warrant the accuracy, reliability, and truthfulness of any information, Creative Briefs, Term Sheets, Responses, and other opinions available through the Site by clients, members, and DigiTec Studios. Any use of Responses shall be at your own risk. You shall assume all responsibility for ensuring that your use of Responses does not violate any of your rights of intellectual property ownership, privacy, or publicity.
(b) Photos & Images: The client is held liable for buying all necessary rights required for utilising any types of photos, graphics, logos, designs, and/or any types of media used within designed work created by DigiTec Studios (websites, brochures, business cards, signage, animations, commercials, promotional items, etc.). DigiTec Studios does not assume liability for any non-royalty-free media.
(c) Legal Agreement & Updates: Your use of DigiTec Studios is conditioned upon your acceptance of these Terms and Conditions. It is your responsibility to review them periodically, since they may change without prior notice. The term “Service” will also include all services, content, and materials made available through the website.
(d) Content Control & Legal Compliance: DigiTec Studios may reject, remove, or edit projects or content that violate these Terms, are objectionable, or unlawful. We may disclose account information or content if required by law, to enforce Terms, respond to claims, provide customer support, or protect rights, property, or safety of users and the public.
